Judge Upholds 1930s Wisconsin Gas Law

MADISON, Wis. -- A judge upheld a Wisconsin law dating to the 1930s requiring retailers to mark up the price of gas, as reported by area television station WIFR.

A Wisconsin gas station owner, Raj Bhandari, filed a lawsuit last year challenging the law after he said regulators forced him to stop giving a 2-cent per gallon senior citizen discount. Bhandari argued the minimum markup law violates the state constitution's equal protection clause because retailers who sell gasoline are unfairly singled out for regulation.

But the state's Dane County Circuit Judge Maryann Sumi sided with the state and threw out Bhandari's lawsuit.

Bhandari's attorney, Robert McNamara of Arlington, Va., earlier vowed to take the fight all the way to the state Supreme Court.
